Safety signage

Signs will now be a part of law as All smokefree premises must display no-smoking vinyl signs in a prominent position at each entrance that is the equivalent of A5 in area, displays the international no-smoking symbol in colour, a minimum of 70mm in diameter, and carries the words in characters that can be easily read: “No smoking. Signmakign has become quite important as It is against the law to smoke in these premises”. The words “these premises” may be changed to “this hotel” or “this shop” etc.

indoor shopping centre can display the international no smoking symbol in colour, a minimum of 70mm in diameter.

Introduction

From 1 July 2007 any premises that are open to the public, or are used as a place of work by more than one person or where members of the public might attend to receive or provide goods or services are to be smokefree in areas that are enclosed or substantially enclosed. This includes common areas within residential property.

Premises

Premises are enclosed if they have a ceiling or roof and, except for doors, windows or passageways, are wholly enclosed, whether on a permanent or temporary basis.

Premises are substantially enclosed if they have a ceiling or roof, but there are permanent openings in the walls which are less than half of the total areas of walls, including other structures which serve the purpose of walls and constitute the perimeter of premises. No account can be taken of openings in which doors, windows or other fittings that can be open or shut.

A roof includes any fixed or movable structures, such as canvas awnings. Tents, marquees or similar will also be classified as enclosed premises if they fall within the definition.

Smoking shelters must not be substantially enclosed.

Penalties
Local authorities will enforce penalties of:
• £2500 For failing to prevent smoking in a smokefree place
• £1000 or a fixed penalty of £200 discounted to £150 if paid within 15 days for not displaying a no-smoking sign
• £200 or a fixed penalty of £50 discounted to £30 if paid within 15 days for smoking in a smokefree place.
